Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Orbit: LifeOS application ("Orbit", "the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Description of Service

Orbit is an AI-powered goal achievement application that helps users set goals, create strategies, track daily actions, and review progress. The App uses artificial intelligence to generate personalized plans, daily actions, weekly analyses, and coaching responses.

Orbit is not a substitute for professional advice. The App provides general goal-planning assistance and should not be relied upon as medical, nutritional, psychological, financial, or other professional advice. Always consult qualified professionals for health, fitness, or other specialized guidance.

3. Account and Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent that you are at least 13 years old.

You may sign in using Apple Sign-In or use the App anonymously. You are responsible for maintaining the confidentiality of your account and for all activities that occur under it.

4. Subscriptions and Payments

4.1 Free and Pro Plans

Orbit offers a free tier with limited features and a paid subscription ("Pro") with additional features. Details of what is included in each plan are described within the App.

4.2 Free Trial

New users may be offered a 14-day free trial of Pro features. At the end of the trial, you will be charged the applicable subscription fee unless you cancel before the trial period ends.

4.3 Billing

All payments are processed through Apple's In-App Purchase system. By subscribing, you agree to Apple's payment terms. We do not directly collect or store your payment information.

4.4 Renewal and Cancellation

Subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel at least 24 hours before the end of the current period.

To cancel: Go to your device's Settings > Apple ID > Subscriptions > Orbit, and select Cancel Subscription. Cancellation takes effect at the end of the current billing period. You retain access to Pro features until then.

4.5 Refunds

Refund requests are handled by Apple in accordance with their refund policy. We do not process refunds directly.

6.1 Nature of AI Content

Orbit uses AI to generate strategies, daily actions, analyses, and coaching responses. This content is generated automatically based on the information you provide and the AI model's capabilities.

6.2 No Guarantee of Accuracy

AI-generated content may contain errors, inaccuracies, or suggestions that are not appropriate for your specific circumstances. We do not guarantee the accuracy, completeness, or suitability of any AI-generated content.

6.3 Health and Fitness Disclaimer

Orbit may generate suggestions related to exercise, nutrition, weight management, or other health-related topics. These suggestions are for informational purposes only and are NOT medical advice. You should:

You are solely responsible for any actions you take based on the App's suggestions. We are not liable for any outcomes resulting from your use of AI-generated content.

7. Intellectual Property

7.1 Our Rights

The App, including its design, code, branding, and original content, is owned by Tatsuya Tajima and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the App without our written permission.

7.2 Your Content

You retain ownership of any content you create within the App (goal descriptions, reflections, notes). By using the App, you grant us a limited license to process this content for the purpose of providing the service, including sending it to AI service providers as described in our Privacy Policy.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

We provide the App "as is" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of profits, personal injury, or health outcomes.

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Tatsuya Tajima, his officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App or violation of these Terms.

10. Modifications to Service and Terms

We may modify, suspend, or discontinue the App or any part of it at any time, with or without notice. We may also update these Terms from time to time. Significant changes will be communicated through the App. Your continued use after changes take effect constitutes acceptance.

11. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the App ceases immediately. Sections 6, 8, 9, and 12 survive termination.

12. Governing Law and Disputes

These Terms are governed by the laws of Tokyo, Japan. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in Tokyo, Japan, except where prohibited by law.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Tatsuya Tajima regarding your use of the App.
